Warranty Period

The Contractor warrants the painting services ("Services") performed at the Property under the Painting Services Contract dated for a period of 5 years from the date of project completion ("Warranty Period").

Warranty Coverage

Workmanship

The Contractor guarantees that all painting services were performed in a professional and workmanlike manner, consistent with industry standards. This includes proper surface preparation, application of paint, and adherence to manufacturer specifications.

Defects Covered

The Contractor will repair or repaint, at no cost to the Client, any areas where the paint exhibits defects directly attributable to improper application, including but not limited to:

• Peeling, flaking, or chipping of paint.
• Blistering or bubbling due to faulty application.
• Significant cracking caused by improper surface preparation.

Materials

The Contractor warrants that all materials used (e.g., paint, primers) were of professional quality and applied according to manufacturer guidelines. Any manufacturer warranties on paint or materials are passed through to the Client as provided by the manufacturer.

Exclusions

This warranty does not cover:

• Damage caused by normal wear and tear, including fading due to sun exposure or weathering.
• Defects resulting from Client negligence, misuse, or improper maintenance (e.g., failure to clean painted surfaces as recommended).
• Damage caused by structural issues, water leaks, or other conditions at the Property beyond the Contractor’s control.
• Pre-existing conditions not addressed in the original scope of work.
• Changes in paint color or sheen due to natural aging, acts of nature or environmental factors.
• Work performed or materials applied by parties other than the Contractor.

Warranty Claims Process

• The Client must notify the Contractor in writing within the Warranty Period, describing the defect and providing photos or other evidence.
• The Contractor will inspect the reported issue within 10 days of receiving the claim.
• If the defect is covered under this warranty, the Contractor will, at their discretion, repair or repaint the affected area(s) using materials and methods comparable to the original Services.
• All warranty repairs will be scheduled at a mutually agreeable time and completed within a reasonable timeframe.

Limitations

• This warranty is non-transferable and applies only to the original Client at the Property.
• The Contractor’s liability under this warranty is limited to the cost of labor and materials required to remedy covered defects, not to exceed the original contract price.
• The Contractor is not liable for consequential or incidental damages, such as property damage or loss of use, arising from defects.

Maintenance Recommendations

To maintain the longevity of the painted surfaces, the Client is advised to:

• Clean painted surfaces periodically with mild soap and water, avoiding abrasive cleaners.
• Address any water leaks or structural issues promptly to prevent damage to painted surfaces.
• Follow any specific maintenance guidelines provided by the paint manufacturer.

Governing Law

This warranty shall be governed by the laws of the State of Colorado.
